Use of PrivacyGuard AI does not guarantee regulatory compliance with GDPR, CCPA, CPRA, HIPAA, or any other applicable law or regulation. By accessing or using PrivacyGuard AI ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including free and paid subscribers.
PrivacyGuard AI provides automated privacy compliance tools including, but not limited to: website compliance scanning, AI-generated privacy policy and terms of service documents, cookie consent widget builders, Data Subject Access Request (DSAR) management portals, compliance analytics, and AI-powered compliance assistance. All outputs are generated using artificial intelligence and automated processes.
3.1 Informational Purposes Only. All content, reports, scores, generated documents, recommendations, and outputs provided by PrivacyGuard AI are for informational purposes only. Nothing provided by PrivacyGuard AI constitutes legal advice, and no attorney-client relationship is formed by your use of the Service.
3.2 No Guarantee of Compliance. PrivacyGuard AI does not warrant, represent, or guarantee that use of the Service will result in compliance with any law, regulation, or regulatory standard, including without limitation GDPR, CCPA, CPRA, HIPAA, COPPA, CAN-SPAM, or any state, federal, or international privacy law. Regulatory compliance is a complex, fact-specific determination that requires qualified legal counsel.
3.3 Disclaimer of Warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.
3.4 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRIVACYGUARD AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: (A) REGULATORY FINES, PENALTIES, OR ENFORCEMENT ACTIONS; (B) LOSS OF PROFITS, REVENUE, OR DATA; (C) LEGAL FEES OR COSTS; (D) BUSINESS INTERRUPTION; OR (E) ANY OTHER DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
3.5 Cap on Liability. IN NO EVENT SHALL PRIVACYGUARD AI'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PRIVACYGUARD AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
3.6 User Responsibility. You acknowledge and agree that you are solely responsible for: (a) reviewing all AI-generated outputs before use; (b) consulting qualified legal counsel before implementing compliance measures or publishing generated documents; (c) ensuring your business practices comply with all applicable laws; and (d) any regulatory fines, penalties, or enforcement actions resulting from your business operations.
PrivacyGuard AI uses artificial intelligence to generate compliance documents, recommendations, and analysis. AI-generated content may contain errors, omissions, or inaccuracies. You must independently verify all AI-generated content before relying on it for any purpose. PrivacyGuard AI expressly disclaims all liability for errors or inaccuracies in AI-generated content.
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law. PrivacyGuard AI reserves the right to modify pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
You agree not to use the Service for any unlawful purpose, to scan websites you do not own or have authorization to scan, to reverse engineer or attempt to extract the underlying AI models, or to resell or sublicense the Service without written permission.
PrivacyGuard AI retains all intellectual property rights in the Service, including its software, AI models, and branding. You own the policies and documents we generate for you. PrivacyGuard AI retains the right to use anonymized, aggregated benchmarking data to improve the Service. You may not resell, sublicense, or redistribute AI-generated outputs as standalone products without written permission.
PrivacyGuard AI may terminate or suspend your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Pembroke Pines, Florida, in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
PrivacyGuard AI reserves the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
